1. Who We Are
The service is operated by chatwithme.fun ("we", "us", or "our"), trading as chatwithme.fun. We are the data controller responsible for your personal information under applicable privacy laws.

2. Information We Collect
Information you provide: email address, username, display name, date of birth, profile bio, interests, and location (optional). If you upgrade to Premium, payment is handled entirely by Stripe — we never see or store your card details.
Information collected automatically: IP address at signup and login, device type and browser, usage activity (pages visited, features used), and error logs. We use this to operate, secure, and improve the service.
Session activity logs: when you are signed in we record the time you log in and log out, the resulting session length, and the pages you visit during that session. This is linked to your account and lets us measure engagement and how long members stay. Our staff can view this activity for support, safety, and analytics purposes; access is restricted to authorised administrators. These logs are automatically deleted after 90 days, and are erased immediately if you delete your account (see Data Retention and Your Rights).
3. How We Use Your Information
- To create and maintain your account and provide our services
- To authenticate your identity and protect your account from unauthorised access
- To send service-related communications (email verification, password reset, security alerts)
- To detect and prevent spam, abuse, and fraudulent accounts
- To moderate content and enforce our Terms of Service
- To process Premium subscription payments via Stripe
- To improve the service through aggregated, anonymised analytics
- To measure engagement and how long members stay, using signed-in session activity logs (login/logout times and pages visited)
Lawful basis for processing (EEA, UK & Switzerland users)
Where the GDPR or UK GDPR applies, we process your personal data under the following legal bases:
- Contract — processing necessary to provide the services you signed up for (account creation, messaging, calls).
- Legitimate interests — security monitoring, abuse prevention, and service improvement, where these interests are not overridden by your rights.
- Legal obligation — where we are required to retain or disclose data by law.
- Consent — where we explicitly ask for your consent (e.g., optional marketing communications). You may withdraw consent at any time.
4. Information Sharing
We do not sell your personal information. We share your information only with:
- Other users — profile information you choose to make public is visible to other members based on your privacy settings.
- Service providers — trusted third parties that help us operate the service, including cloud hosting, payment processing (Stripe), email delivery, real-time infrastructure, and content moderation. These providers are bound by data processing agreements and may not use your data for their own purposes.
- Legal requirements — when required by applicable law, court order, or to protect the safety, rights, or property of our users or the public.
- Business transfers — in the event of a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will notify you beforehand.
5. Messages & Content
Messages you send are stored on our servers to enable conversation history and real-time delivery. Room messages and direct messages configured with a disappearing timer are permanently deleted after the period you set. You can delete your own messages at any time from within the app. We may review content flagged by our automated moderation systems to investigate potential Terms of Service violations.
6. Data Retention
We retain your account data for as long as your account is active. If you request account deletion, your profile and messages will be removed from our systems within 30 days, except where we are required to retain them by law (for example, payment records required for tax or fraud-prevention purposes).
Session activity logs (login/logout times, session length, and pages visited) are kept for 90 days and then deleted automatically. If you delete your account, these logs are erased as part of that process.

7. Cookies & Local Storage
We use cookies and browser local storage in three categories. Strictly necessary cookies maintain your session, remember your preferences, and keep the site working — these are always active and cannot be turned off. Analytics cookies help us understand how the service is used so we can improve it. Advertising cookies let us and our partners show and measure relevant ads to support the free service. Analytics and advertising cookies are optional and are only set after you consent.
When you first visit, we ask for your consent and you can accept all, reject everything non-essential, or choose per category. You can change or withdraw your consent at any time using the “Cookie settings” link in the footer. You can also clear cookies and local storage via your browser settings; doing so will sign you out.
8. International Data Transfers
chatwithme.fun is operated from and stores data in the United States. If you are accessing the service from the European Economic Area (EEA), United Kingdom, or Switzerland, your personal data will be transferred to and processed in the US. We implement appropriate safeguards for such transfers, including standard contractual clauses approved by the European Commission, where required. By using our service, you acknowledge this transfer.
9. CSAM Reporting & Law Enforcement
chatwithme.fun is legally required under 18 U.S.C. § 2258A to report apparent child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) CyberTipline. When we identify apparent CSAM, we immediately remove it, preserve the associated data, and file a report with NCMEC. We cooperate fully with law enforcement requests, including providing account information, IP addresses, and message records under valid legal process (subpoenas, court orders, or search warrants).

11. Security
We use industry-standard security practices including encrypted connections (HTTPS/TLS), password hashing (Argon2id), and strict access controls to protect your information. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at hello@chatwithme.fun.
12. Children's Privacy
chatwithme.fun is intended for users aged 18 and over. We collect date of birth at signup and block accounts that do not meet the minimum age requirement. We do not knowingly collect personal information from minors. If you believe a minor has created an account, please contact us at hello@chatwithme.fun and we will delete the account promptly.
13. Your Rights
Depending on your location, you have the following rights regarding your personal data. You can exercise the access, portability, and erasure rights directly from Settings → Account. For all other requests, contact us at hello@chatwithme.fun.
- Access — request a copy of the personal data we hold about you. Use Settings → Account → Download my data.
- Rectification — ask us to correct inaccurate or incomplete data.
- Erasure ("right to be forgotten") — delete your account and all personal data from Settings → Account → Delete account, subject to legal retention obligations.
- Data portability — receive your data in a structured, machine-readable format. Use Settings → Account → Download my data.
- Restriction — ask us to pause processing of your data in certain circumstances.
- Objection — object to processing based on legitimate interests or for direct marketing purposes.
- Withdraw consent — where processing is based on consent, you can withdraw it at any time without affecting the lawfulness of prior processing.
EEA, UK & Switzerland users: If you believe we have not handled your data in accordance with applicable law, you have the right to lodge a complaint with your local data protection supervisory authority. A list of EEA supervisory authorities is available at edpb.europa.eu.
California (CCPA) users: You have the right to know what personal information we collect and how it is used, the right to delete your personal information, and the right to non-discrimination for exercising your rights. We do not sell personal information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting a prominent notice on our service or by email at least 7 days before the changes take effect. The "last updated" date at the top of this page reflects the most recent revision. Continued use of chatwithme.fun after changes take effect constitutes your acceptance of the revised policy.
